I have a question for you---this appeal doesn't preclude the Judge from appointing an Examiner whenever she wishes does it-----

No it doesn't. The appeal will be withdrawn if JMW rules on the second motion for an examiner for it's approval.

And if she did, that fact wouldn't stop the progress toward settlement automatically would it----couldn't the settlement process move forward and if they reached an agreement the Judge could just release the Examiner from the case------

Not sure. Maybe drrugby or someone else can help with this.
