Based on the information detailed, a named MMPIQ employee, who I will not disclose, approached Chris Zadoorian (Geo) on 3/19/10 regarding the 1099 Grand Ave project with a letter for review and signature.
The letter provided specific information regarding issues discussed within the committee, relating to current counsel (Rallis) and concluded he was not properly representing the committee. There was a signature block at the bottom. He goes on to say that there is no way MMPI could have obtained the information without inside information. The letter indicated that Rallis, in engaging the financial advisor (KGI), was acting against the committee's vote. It was not. The Debtor had not provided any financial information to the OCC when requested.
