He tried to go to the climate change conference with a cap and trade tax already in place, but it didnt make it through the senate. I would say his best shot is 50/50. He has a better chance of negotiating something lower. He must face the electorate this year, so he may be looking for an election trigger where he can look like a hero to the average punter.
If the senate blocks legislation he can use it to trigger a double dissolusion, which is both houses going to the electroate. He threatened a DD over the cap and trade, but must have thought better of it. JMHO.
