I haven't checked the court calendar, but I believe the EC's motion to intervene was not granted yet so technically Rosen did not have to include the ec in the settlement proceedings as of yesterday's hearing. I think posters are too harsh on the ec lawyers. I think the lawyer expected the summary judgment to go forward yesterday, having not been contacted about any settlement. I believe that what Rosen did is going to be his ruination. What goes around comes around.
