Yes, they would. Your "thousands" of witnesses could file affidavits (I, unlike Gussie, know how to spell it), but probably no one would bother to read them.

And in any case, I'm guessing that all but a hundred or so Xers are unwilling to throw yet more good money after bad. Talk is cheap; lawsuits cost money.
