I would second that "thesis".

Reading a judge is not easy - even for the experienced observer.

For example, a judge that consistently rules against objections by one side and in favor of the other sides objections, in might be assumed to favor the side getting the favorable rulings.

That is precisely what happened during the patent trial to invalidate the lovenox patent.

But the correct read was that the judge had already decided to invalidate the patent. Since that was where she was headed, she gave every ruling to SNY. That way on appeal, SNY would not be able to claim their case was prejudiced by her errors.
