He was in jail for several months for contempt of court. The SEC prevailed in its lawsuit, and Fluffy is currently paying down a big fine. USXP's registration has been revoked.

Unfortunately, so far there's been no move by the DOJ, though as we all know, they sometimes take forever. Fluffy seems to be trying to set up a new business, based in Switzerland, but he doesn't seem to have made much progress with that.
