The bottom line is we don't know, cuz the company wouldn't file.

What we do know is the SEC did indeed proceed with an investigation following the suspension, and they've found enough to ask for a Wells Submission. This stands in stark contrast to "Everything's OK," "The SEC (or FINRA) is previewing the 10K in an attempt to keep from bankrupting the broker-dealer system," etc. The regulatory circle has officially cinched more tightly.
