**The longer we go without a summary judgment I do think the better the chance for a ruling to WMI. Denial would have happened already.

Trial..or not. That is the question I believe Walrath is contemplating at this point. We're heading into week two of 'as soon as possible'. This goes much longer and Walrath starts to just look like a judge that can't 'judge'.

She needs to make a decision either way, very shortly.
