Exactly who is appealing? The plaintiff's have settled ,the judge has approved the settlement and torpedoed the intervenors filings.The appeal process would have to be by the unit holders who have not filed a suit to date in this case,as they were only represented by the plaintiff's attorneys who settled,the unit holders(this board) were not the plaintiff's.So now who would you sue,the defendant's with a new case,lawyer and fresh funds? The plaintiff's for misrepresenting your interests,with a new case,lawyer and fresh funds? The court for malfeasance in the decision that only involved the unit holders as an appendage to the suit,with a new case,lawyer and fresh funds?Or hire a class action lawyer to eat up your funds over a 5 year period and line their pockets? Good luck with these alternatives.The case as filed is over,the plaintiff's ,defendant's and court were satisfied and settled.Those are the only three necessary. Anything else is back to square one.You will get your part of the settled amount and whatever the properties fetch.
