They settle with Ericy because of some mandate(don't know what that was).
But immediately after they settle they state pubilically that NOK and SAM owe them hundreds of millions of dollars. (a lot of people say they shouldn't have done that so publically)
I bet they did it, because I think they suspected, after negotiating with NOK for a while, that NOK was attempting to rape them on the rates or even not pay them at all. So IDCC called them out publically.
NOK goes to arbitration and shows that they never really wanted to pay IDCC the money that they owe (but pennies on the dollar) and one of the NOK lawyers actually says to Judge Lynn that NOK never thought they would have to pay IDCC these rates because Ericy would smack IDCC around in court.
IDCC has $125 million in the bank, just about going to be profitable quarter over quarter, they have extremely valueable 3G IPR, and NOK and SAM outstanding bill is growing everyday that they wait to pay.
All IDCC needs to do, is to convince a handful of players to sign with them, and hopefully large enough to put more pressure on NOK, and take some pressure of IDCC. Every licensee that IDCC signs that has a high profile name, makes it easier to sign the next one. The time frame of Jan 2005 just gave IDCC mgmt more time to get some deals done. These kind of deals, like Toshiba, are very valuable, a couple more would be nice before the end of 2004.
