James Duncan: Aside from what is mentioned above, Mr. Duncan has been the subject of termination by Olde Discount Brokers for investment fraud and was ordered by the States of Washington and Iowa to cease and desist in fraudulent activities following administrative proceedings finding him to the perpetrator of fraud against victims in those states. (See Exhibits “19" and “20"). Obviously, Mr. Duncan did not feel a need to cease and desist, regardless of the fact that he had been administratively adjudged to be guilty of defrauding others. Given the lack of any meaningful criminal action against him in Iowa and Washington, he was allowed to continue in his fraudulent activities. From the evidence further acquired by an investigator for Plaintiff’s counsel, it appears that Maurice McLeod and James Duncan met up in Iowa as evidence suggests that McLeod’s father was involved in some type of scam in Iowa. Said evidence will be disclosed in conjunction with FRCP Rule 26 disclosures. In the present instance, Duncan appears to be the mastermind of the scam perpetrated against the persons listed in Exhibit “1.” He has the most experience in investment scams and other financial activities. Hendrix Montecastro and Charlie Choi appear to be proteges’ of the other two defendants.
