Is a stay usually granted during the appeal to the Federal Circuit? If so, would NOK have to post another bond or could they continue to import during the pendancy of the proceedings?
Would IDCC face any jeopardy of having to post a bond for the purpose of making NOK whole for lost revenues during the Federal Circuit appeal, if NOK won there?
It is my opinion that the Federal Circuit will have the last word on the validity and the infringement issues. I don't believe that there is a question which would merit a grant of certiorari to the Supremes.
