The "bashers" in question would have to make disclosure with every post, in compliance with Section 17b of the Securities Exchange Act of 1933, just as paid touts are obliged to do.

As long as they posted factually about Frank's past I believe that it certainly would be.....and wouldn't those posters then (by the definition of some) be correctly called "paid bashers" ?
