"One of the most profound duties of any public, or private, company is to protect its customers from wrongdoing by any of its employees."

This was your response to Phil's comment that "it's not up to IHub and the admin to try to regulate it."

IHub has zero responsibility as far as I'm concerned to regulate against scams. Obviously, they have a responsibility to regulate EMPLOYEES (of which, Matt was one). Because of that, they have a very large legal exposure IMO if he is found guilty of using IHub for illicit gains - although he hasn't been charged with that at this time.

But, the main argument here is that many believe IHub is responsible for CONTENT. That's absurd and will NEVER be held up in a court of law. If it were, every message board that exists today would fold tomorrow.

IHub is a FORUM only - no different than the telephone or email. MA Bell is not responsible if you commit a felony over the phone and Microsoft is not responsible if you use Outlook to send an email that contains a felony.

Even if it were possible (and it isn't possible within a hundred miles) for IHub admin to police scam content, it would be impossible to implement. The "truth" is an incredibly difficult thing to know and "proof" one way or the other is largely in the eye of the beholder. It would be like trying to shoot a moving fly with a BB gun - impossible. And, if that weren't enough, IHub would have to increase admin from a handful to a few hundred - and they would have to become experts on a myriad of legal issues. In other words they would have to become the SEC!
