Until there is complete reform and sunshine on these companies there will get away with it. Why? Just look at all the "Get Out Of Jail" language they get to use at the end of each PR. If they had to be honest a typical PR disclaimer might read:

"The above language is merely reflective of what we would like to do if we really had an business. In reality the company is engaged in the business of share selling to idiot investors that lack the common sense to realize a hoax when they see one"
