When they lost this 'fight' to be excluded from the proceeding against them
the judge rejected their arguments and the judge refused to give them back a
$ 50,000 guarantee that was posted in case ECT loses the upcoming trial for
damages.

So yes, the $ 50,000 is in escrow.
