Well, I'll keep my dog out of this fight, but I will say when I talked to Ms. White two days ago she told me that when the discovery phase begins, Marco's depo would be available. She also stated that he hasn't been served the complaint yet, so it will be a while (paraphrased).

Of course, now that she has the appropriate address to serve him (home and business) hopefully this ball will get rolling.

If Marco settles with the SEC then we would have to wait until any criminal investigation enters discovery in order to see the depo then... Right?
