it seems the broker or dealer can meet the "close-out requirement" by entering a "pre-borrowing" agreemnt.

it's not good that it rose. still, i notice that the short interest never exceeded 4,084,917 shares. now, one of our theories has been that the CD holder was naked shorting the stock like mad, effectively creating tons of "phantom shares" (which would be covered upon conversion). however, 4 million really isn't that many.. that almost makes me think the shorting has been legit. or do naked shorts not show up in the Short Interest?
