I guess the following settlement announcement gets Motorola out of ITC investigatin 337-605 which is pending the ALJ's ID in December. Maybe Merritt is right about serious negotiations front running the ALJ's ID.

Tessera signs licensing deal with Motorola, no terms disclosed
SAN JOSE, Calif. (AP) -- Semiconductor supplier Tessera Technologies Inc. said Monday it has signed a deal with communications gear maker Motorola Inc. for an option to license its chip scale packaging technology.
The option enables Motorola to enter into a pre-negotiated license agreement with Tessera and settle all outstanding litigation between the companies, the company said.
Terms of the agreement, including the time period and financial details, were not disclosed.
