On what argument will they won the lawsuit? And on what basis do they have to even file the lawsuit to begin with?
Has the lawsuit been filed?
Which county is the lawsuit filed in?
What is the docket number of the lawsuit?
When do depositions begin?
Without all of those questions and more answered, how can anyone predict that a lawsuit will be successful.

Numbers don't lie...people do!
