No way it's a cricket.

I have never heard a cricket chirp from high in a tree.

Plus, they are not chirping here yet and it's a totally different chirp. No where near as loud either.

The reason I think it's a bird is because we have heard it two other neighbor's yards. Most of the time the bastard is right outside my bedroom window.
