I have been trained to identify and expect the worst from my opponents and judges. If I was Nok I would welcome the opportunity to have a preview on the technical side of the case. Naturally, you are going to risk certain mutual affirmative defenses being poured out along the way, but the ability to add or subtract evidence regarding validity and infringement during a second hearing is a huge advantage. I also do not believe for a minute that Nok will not be screaming for a recusal of Judge Luchern in the event of severance. The less opportunities given to the Nok legal team, the better as far as I am concerned. They are either extremely lucky, good or blessed based on the rulings I have witnessed and my tendency is to analyze both positions thoroughly before I make a prediction to myself. I know you are from the same school of thought and confusion has been the result for me so far.
