The right to arbitration is considered a right enforceable by extraordinary relief (like an injunction.) The damage to IDCC arising from interference with their ITC proceeding - if it is unlawful - would likely pose a problem if they were seeking extraordinary relief because IDCC would have an adequate remedy at law, namely, money. Damage which can be compensated by money is not irreparable.
