yea, but 2g isn't 3g.
i believe (correct me if i'm wrong) ericy didn't get a mfl for 2g. ericy has "validated" idcc's 2g package. imo, if they were waiting for nok "validation", the 2g deal between idcc and ericy would never have happened and it would have gone to court. nok isn't fighting over 3g right now, it is 2g that is the problem. ericy is paying what they agreed to and their rate for 2g is final.
idcc has proven 3g rates with others, reguardless of what happens with nok. they should be able to come to terms with ericy for 3g. it has been an assumption of this board (and stated enough that some believe it to be fact) that the 2 are tied together. unless i missed it, i have never seen anything from the company that stated that is the case. they have been "very quiet" on the ericy 3g subject.
2g and 3g are separate critters, imo. ericy has one heck of a "true up" for 3g if what you state is the case. they seem to be stalling on 3g now like nok is doing for 2g. will the "true" true up come or will that get negotiated away also.
