No_chkn re legal costs of Lucent lawsuit

Although Tantivy still exists as a corporate entity, it is my understanding that it is no longer an operating entity. So even though the legal suit is in Tantivy's corporate name, I believe that the litigation costs against Lucent will be borne by IDCC. However if the litigation is successful, then I don't believe that Tantivy's owners will be entitled to any of the resulting settlement amount or ongoing royalty from Lucent.

As I understand the purchase contract with Tantivy, they are not entitled to anything more from IDCC, unless IDCC subsequently licenses Tantivy's 802 or smart antenna patents. Therefore any CDMA2000 patent from Tantivy not involving smart antenna technology would be excluded from any additional royalty payments from IDCC. I don't think any of the seven patents involved in the lawsuit with Lucent involved smart antenna technology, but I could be wrong on this point. And even if they do involve smart antenna technology, then Tantivy owners would only be entitled to 1%.
