It could still be a problem. Just because they have initiated
bankruptcy proceedings does not mean the intellectual property
does not exist anymore. It is still an asset of the company
(if it was and unless proven otherwise by a judge). The
trustee has to proceed in a manner that is best for the
company (and its shareholders) during the bankruptcy
reorganization (or liquidation) until the judge rules.
