In my opinion there is enough for a shareholder suit, but is it worth the cost and effort? Regarding whether Nova paid IBCL, I don't know but I surmise not or the payment was not what we were told it would consist of, but I can't get a hold of someone at Nova to find out those details.
This sentence by you is most interesting.
"Don't bankruptcies usually end up selling off the assets? Is the logical buyer of the product NOVA? Would JE try to get his hands on it? (Not good for NOVA.)"
IBCL filed chapter 11 which would be a reorg and not a liquidation of assets. A Chapter 7 is the selling of assets. However, when they filed bankruptcy for eMD.com they filed first as an 11, then converted it to a 7 and yes IBCL bought some of the assets of eMD.com. So would Nova this time around do the same? I don't know. Not sure anything remains in IBCL worth anything. One can surmise that the patents and other intellectual property was sold from IBCL to Nova to avoid JE getting his hands on it, although I'm not sure the right term is "sold".
Questions can and should be addressed to the bankruptcy attorney in San Antonio. I'm kind of wondering where Hicks stands on all of this, or did he make enough shorting the stock to cover his investment?
I to have many questions.
The best weapon against "fear" is "facts"!!
