KM can't enter the United States, anyone knowing his history knows that the only reason he was in the USA was per an extradition order from Canada. That order prohibited the United States from moving forward with a contempt of court "indictment." The "rule of specialty" prohibits prosecution unless he enters. Under the treaty, if he voluntarily enters the USA, they can proceed with that indictment. The statute of limitations isn't up until 2009.
As far as arguments, rhetoric and jabs don't make a good appeal. It might prejudice a judge, but when you appeal, it's on paper and it's more about the law.
But what does it affect? As I stated before, Corey will fight long and hard in New York and win what? The company can be liquidated the day after that event. Doesn't make sense what he asked for.
