Yes, it was. But, how are you going to get anyone to appear for a deposition or produce documents if you can't find 'em.

The discovery will only proceed as to people and entities they can find - like a trust.

And, (even assuming the trust can be busted) when Frizzell and West find the trust was looted by UC before the suit was even filed and it now has no assrts, how will that help anyone?

And, BTW, you can't get a default judgment against a party unless and until he/she is properly served. It's the first thing any judge looks for in the court file at the prove up of a default. ... eom
