nuffie, ... You are partly correct. Service by publication for Edwards was approved on July 11 - prior to the running of the 120 days.

Then, with authority to serve Edwards by publication, CMKX sent out service by certified mail July 12 and filed the notice of having done so on July 13.

There is no record of service by publication having been attempted or completed after approval for such action was given. The notice of certified mailing is the last entry.

And, if you check the Parties page for that case, Edwards is still shown as unserved.

Perhaps service by certified mail will be effective. It depends on where the mailing was sent. But, having sought and been granted approval to serve by publication, why not do it too.

BTW, being "up for publication" (your term) is not the same as publication having actually taken place in a newpaper of general circulation.

My question is why Frizzell and West are diddling around with the case for so long. Service on all parties should have been accomplished long ago. This is first year law school stuff. ... eom
