Yes, this is an absolute joke. I cannot think of a more expensive method for companies who typically license via "bundle" to position themselves for licensing negotiations. The shareholders of both companies should be screaming "no mas". The court system in the UK should never have extended the discretionary powers of a judge to go into the patent review business. UMTS and several other firms have offerred services to analyze patents for intersection with the standards. The international standards groups as a whole should take some responsibility for establishing objective methods for determining essentiality and FRAND. After all, they are dealing with businesses that operate under many different jurisdictions ranging from mandatory price fixing to price fixing prohibition in their ecosystems.

It goes back as far as Moses when he came down from the Mount and gathered the nations to discuss the commandments (standards). The adultery issue came up and the French went ballistic. The no stealing issue came up and the Chinese walked out. Moses was at a loss, he had over a hundred proposed commandments and was getting nowhere. Finally, a Jewish delegate rose up and asked Moses how much do commandments cost. Moses replied that the commandments are free. The Jewish man replied that he would take ten of them and this is how the the first international standards were created.
