UMTS and several other firms have offerred services to analyze patents for intersection with the standards. The international standards groups as a whole should take some responsibility for establishing objective methods for determining essentiality and FRAND. After all, they are dealing with businesses that operate under many different jurisdictions ranging from mandatory price fixing to price fixing prohibition in their ecosystems.
