It's my understanding that a lender is given much the same access to inside information as a potential partner or buyer of the company. It's done under confidentiality agreements, but whoever lent the company funds very probably knows far more about the status of the approval, the acceptance of the EDEN, etc. than any of the rest of us. While the lender got great terms, without it the company would have had to dilute tens of millions of shares, or more, while after approval they should be able to pay back the loan with a few million shares. In that way it's a good deal for the company, and its investors.
