i'm not a regulator or a lawyer but i think releasing a forward looking PR while hiding a rejection/appeal to the core business you've been building for 20 years still counts as misleading. SEC standard is what would a reasonable investor think. The external clients language to me sounds internal positioning. They said their experience has shown them leukapheresis is genuinely in short supply.
