It's good that you are finally coming around to realizing that all of this is opinion including yours and everyone else's.

Yes the case can be "evaluated". That is an opinion based on the available information. Still an opinion, a prediction of the future.

And yes what I said in my posts is my opinion. If it makes you happier I'll include the word opinion in front of my posts.

You opinion on the possible damage awards is fine. You did contribute the information about the Federal securities statutes precluding punitive damages. For that I say think you.
As for my opinion “This case has been as much about the pain and risk the defendants are exposed to during discovery.” I'll stick with that as being a real factor in the situation.
