The recent uptick in short interest right after the Supreme Court hearing looks less like conviction and more like desperation. If you actually listened to the arguments, the tone clearly leaned in Amarin’s favor, with multiple justices questioning why the case was even being revisited. Yet shorts are pressing harder, likely trying to manufacture fear and shake out weak hands before a potential decision. That kind of positioning can backfire fast—especially if a ruling or signal comes as early as Monday. If the Court affirms or sends it back in a way that preserves Amarin’s position, the current short buildup could turn into fuel for a sharp move upward. At this point, it feels less like fundamentals vs. fundamentals and more like timing vs. positioning—and shorts may be overplaying their hand.
