Even if "forced into a trial that's identical or nearly identical" there is nothing stopping such a trial from adding an additional arm with one of the check point inhibitors.

As long as the approval is conditional, that would be fine.
It is likely that a trial with the check point inhibitors is going to be required at some point anyway.
