The fact that she let a contractor unsupervised to the point of spending $900k designing a device that wouldn't even fit in the area it was needed is, to say the least, maddening.

First of all, Fisk was contracted to implement and build Flaskworks devices back in 2018. So all Eden prototypes had the production design and mfg done by Fisk.

More to the point, it is impossible that as part of this process Fisk did not send the final drawings to NWBO for them to sign off on. So either NWBO accepted the design as they wanted to start work with the prototypes (even if too large), or they just failed look at them.

There is a lot more to this story that the assertions by NWBO in the countersuit. First, early statements by LP (6/2024 ASM IIRC), NWBO has asked for enhancements, but they made the device too large. The idea FISK just went off and built a very different device is not reasonable.

The real question (besides the delay effect that is worse than longs realize) is what enhancements did NWBO want in and how important is their absence? NWBO had a reason for the requests.
