A couple of months brings up the question of whether LP actually takes the Annual Meeting into next year, or holds it this year, perhaps even the 30th or 31st of December, which she did a couple of years ago. Of course, it's possible that if she schedules it late in the year with 30 days' notice, the approval could come before the meeting. Votes however should be scheduled in the notice to investors, she needs to make a very positive case for authorizing more shares if she can't speak about the status of the trial. Frankly, if she believes she has a financial path to not needing more shares for a few more months, I don't know that she doesn't take the meeting into next year after the approval.
The problem may not be that she has a positive story to tell but rather because of the delicate stage with the regulators, she cannot tell us at this time.
