Stokd $NLST Let me add another point: What happens if SK thinks they're going to get crafty and wait till the last second before renegotiating in the hopes that the CAFC decision comes just in time. And then the CAFC remands the PTAB invalidity ruling on a patent, while affirming the District Court jury verdict and damages.

They are going to get screwed as the remand to PTAB will take more time while PTAB validity is unresolved with now more chance to go in Netlist's favor, while damages and validity from jury verdict will stand and collection begin.

It would mean they would have to play games, dangerous games that can be very costly, and with the landscape constantly breeding an unpredictable and fluid environment, it is not something SK would entertain based on their past approach and behavior...IMO of course!

Everyone involved is playing the same game with the same unknowns and possibility of surprises, there are smart players like SK and incredibly shady and dumb actors like Samsung.
