Yes it is. Posner is also representing Phunware, and this court ruling, which was filed today (11/26/2024), bodes well for NWBio’s case against the 7 Market Makers (MMs).

The NWBio case is cited several times in this ruling. This tells me, and it should tell the market, that the MTD will be denied:
