I don't think the judge has ruled on that yet. I haven't checked at this moment. It is expected she should or would given the defense signed off on it as well.
They must think the the statute of limitation will save shitface, and it may do so. But having that over his head is at least satisfying.
And true, there's no time to trial, but being able to prosecute early 2025 would put pressure on congress to impeach. Not that they would though.
But getting rid of that policy would still be the right thing to do. Biden's administration blew it by not firing garland years ago and putting in someone with the experience and balls to fix that wrong.

It is a criminal policy that needs to go.
