biofalcon, in your example you have $23K losses, you can write off a matching amount of your gain, i.e., $10K. I don't know about writing off the additional $3K in losses. However, when you don't sell to show a gain, you are limited to $3K in losses for that and subsequent years until the total losses have been used. Hope that helps some.
