That said, Musk and Tesla claim that FSD was never DOWNLOADED onto this vehicle and Tesla could not verify if any ADA system was in use because that data was never uploaded to them before the accident. Washinton Post however has vehicle data indicating FSD was engaged, purchased, car sufficiently equipped, the ability to transfer FSD to another vehicle, and witness statements accounting for its use.
Where does the confusion come from? Well the confusion comes from Teslas statements that FSD was not DOWNLOADED onto this Tesla. While FSD was not downloaded to the car, could it have been installed in another manner? Or maybe even pre-installed? Patel, Teslas VP of public policy has this to say about the incident:
In this tragic case, we have no data/evidence that any system was or was not enabled and have cooperated with authorities fully, as we always do. What we do know is that FSD beta software was not downloaded onto the car.
Personally i think Tesla is playing the game of words, using truth to mislead. In claiming that the driver didnt download FSD people naturally believe that FSD wasnt installed. However that is not what was said. No one has claimed FSD wasnt installed only that it wasnt "downloaded". Thus opening up the likelihood, given the evidence the Washington Post has, that FSD was installed via a different method: like being pre-installed, transfer from another Tesla, or direct load via a USB device. Any of the mentioned methods would explain how Tesla is being truthful, yet deceptive, while FSD was used when the Tesla killed Mr. Von Ohain. Im just going to add that Tesla and Musk are known for their use of Truth to tell lies. Like when Musk claimed Reuters was lying in its article about Tesla shelving the "Model 2". Tesla has shelved it and Musk never specified what Reuters was "lying" about, but it certainly wasnt in connection to the Model 2.
Here is some conflicting information:
For example, while Tesla reported the crash to the National Highway Traffic Safety Administration as involving driver-assistance software, NHTSA allows the company to redact key information that would shed light on what features were engaged at the time of the crash. NHTSA told The Post that the role of Full Self-Driving was unknown, and that evidence to confirm whether the software was engaged had been destroyed in the crash.
NHTSA indicates evidence to confirm if FSD was in use was destroyed yet somehow Washington Post has vehicle records showing FSD was active.
As part of its reporting, The Post obtained vehicle records showing “Full Self-Driving Capability” as “Active” and “Included” with the car, and a recent message from the company offering von Ohain’s account the ability to “Transfer Your Full Self-Driving Capability to a New Tesla.”

Tesla argues it had no control in the crash and death which were "caused by a superseding and/or intervening force."
There you have it folks Tesla admits an outside force caused this Tesla to glitch and go out of control. That is true, its not Teslas fault, per se, that its vehicles go out of control. Its the destabilized electromagnetic environment we are experiencing as a result of the earths continued weakening of its magnetic field. While I do not disagree that this is an outside force causing its vehicles to go out of control, its precisely why computers on wheels (Teslas/EVs/computerized ICE) should not be on the roads. Because these vehicles will continue to go out of control and with more frequency putting the greater public in danger. EVs will continue to destroy lives whether through killing those involved, created long-term psychological damage, or leading to the incarceration of people who did nothing wrong other than drive an EV.
Also as Tesla is aware of the problem and does not warn the public its liable for everyone of its vehicles going out of control!

The exact cause of the Hutchison Effect is unknown in public spheres as it is classified under national security. However the most likely culprit seems to be a combination of electromagnetic sources coming together in a way to change the makeup of metals leading to their rusting, softening, fracturing, complete breaking, even dustification.
