Just talked directly to Rich (and Bashers... no, I wasn't looking in a mirror).
The press release really does make it clear.
First of all, these dismissals have nothing to do with the Amazon RBR case and the MG cases that are awaiting judgement on the Reconsideration. Those cases are still very much in play. They are also very confident that the Reconsideration will go our way, as Albright has shown to be amenable to considering new explanations and perspectives in the past.
The cases that were dismissed (without prejudice, so they can be re-visited later), were the 2 RBR cases that were just RECENTLY filed a few months ago. The defendants had not even responded yet. The decision was made not to waste time or resources, nor (as Chazzy mentioned) to open VP up to more IPR battles that would also waste resources, so the cases were dismissed without prejudice.
It's not that they felt these cases were too weak to pursue successfully, but rather that the antitrust/class action approach (Ray Leon) is WAY more efficient and effective.
Remember, they are holding the individual DIRECTORS of the telecom companies liable as well. The penalties if they lose would devastate them personally as well as their companies. I was told that no one has been served yet. That spoke volumes to me.
THIS is why time is needed, and the other cases are being sidelined... they are slowly and CONFIDENTLY bringing these folks to the table.
I think where the PR failed a bit was to really communicate how STRONGLY they feel their antitrust case is.
Hang in there, Longs... IMHO our day is coming.... and DB is right about opportunities... holy cow, someone got a hell of a deal at .007 !!
