I ended my last post with thoughts on what's going by saying there's too much to this puzzle and I'll just let it unfold. That’s all we can do given how little we know/understand about the mystery of current events, as all docs regarding this are sealed, other than Samsung’s response to the meet & confer linked below.

We know from this filing that Samsung wants a bench trial on essentiality before jury trial, which is at least 1 reason for conflict with Sept 9 trial date.

Samsung’s initial position was patents are NOT essential—“Samsung’s position throughout this litigation has always been that its products are JEDEC compliant, and that the asserted patents are not infringed and, as such, not essential.”—but now Samsung claims that based on whether there's a finding of infringement would designate whether patents are essential or not.

Remember, Netlist changed positions in prior trials/cases from essential to non-essential, so RAND is off the table.
