Courts are not private businesses. Their case load is rarely optional. Defendant market makers likely clogged the courts more by forcing a combined magistrate then judge confirmation (remember?). Whereas, private attorneys can control their case load, and I would imagine likely need to meet the court’s deadlines rather than the other way around.

Then again, maybe the magistrate’s likely decision has forced negotiations between the parties. That is, if he’s reached a decision.
