They seek dismissal of the STATE LAW CLAIMS ON THE GROUNDS that the GOVERNING LAW CLAUSE This would be the CONTRACTUAL JURISDICTION CLAUSE that states that MA has PERSONNEL JURISDICTION not NY.
THE REASON IS BECAUSE the JURISDICTION CLAUSE in the contract requires the APPLICATION of the LAW OF A STATE DIFFERENT, from the STATES UNDER THE LAWS OF WHICH PLAINTIFF(XERI) SEEKS RELIEF
