While I haven't seen anything the company has done that I believe was fraudulent (failure is not a crime , failure is just failure), if the company did do something illegal I believe your assessment from action taken and if successful is spot on.

Seems like a no win situation if the company is unable to deliver.

Spoiler, its a full write off as opposed to a partial spread out over several years" Guess you could consider this a minor victory, but if the plaintiff knew this was a scam for years (as they claim) wouldn't they have been further ahead if they sold long before the RS.

Lose everything if the company fails completely, lose even more if you wasting money on attorneys trying to get blood from a stone.

I think good luck would be that the company actually delivers before enacting massive dilution, rather then a lawsuit.

But that is just me.
