It was all done BEFORE the MAY 17 2022 letter was signed. Making it TOTALLY irrelevant. Nothing was agreed to before that between XERI/XTI that would prohibit them from seeking another company that could get them to NASDAQ since Duffy was unable to. I guess Duffy will have to prove to the court they ARE connected to the merger NOT THAT IT WOULD MATTER.

He knew that would be impossible to win in Arbitration if he would have gone that route. Lawsuit is nothing more than STALL & DISTRACTION for DILUTION.
